Terms of Service

Effective Date:

These Terms are the agreement between you and TKC Hospitality Group LLC for using the ChopBerry Android application, website, and related services. They describe account responsibilities, creative content, safety, subscriptions, credits, refunds, AI limitations, and dispute handling. By using ChopBerry, you agree to these Terms and the Privacy Policy.

1. Eligibility

ChopBerry is limited to people who have reached age 16. A user who is 16 or 17 must be capable of accepting these Terms under local law and must obtain a parent’s or legal guardian’s review and permission whenever the jurisdiction requires it, including for purchases. Acting for a business or other organization means you confirm you have authority to make these Terms binding on it.

Do not use ChopBerry where access would violate applicable law, sanctions, export controls, or a binding restriction. Additional purchase or platform terms shown by Google Play also apply.

2. Accounts

Available sign-in methods may include email and password, Google, or Facebook. Information you submit must be accurate, and you are responsible for keeping credentials secure and for activity performed through the account. Contact support@chopberry.com promptly if you suspect unauthorized access.

An account may not be sold, rented, transferred, shared in a way that creates fraud or security risk, or created in bulk without permission. You can request permanent deletion in the app or by email if you cannot access the app. Deletion is irreversible and does not cancel an active Google Play subscription.

3. The Service

ChopBerry provides AI-assisted photo edits, portrait looks, visual transformations, templates, and short videos created from user-selected media. Features, providers, model behavior, credit requirements, supported formats, and device compatibility can change. A preview, screenshot, or promotional example illustrates a possible use and does not guarantee the same result for every input.

The Service requires a compatible device and internet connection for cloud processing. You grant us permission to process submitted material only as described in these Terms and the Privacy Policy. The Service is licensed, not sold.

4. User content and generated output

Your existing rights in submitted photographs, videos, text prompts, edit directions, and other source material remain yours (“Input”). For the time and purpose needed to deliver ChopBerry, you authorize TKC Hospitality Group LLC and contracted processors to receive, reproduce, transfer, modify, inspect, and temporarily retain that Input around the world. This narrow permission covers delivery, protection, fault investigation, and customer help, then ends after applicable processing and lawful retention.

We make no ownership claim over a result created for your request (“Output”) as between the parties and where the law permits that position. Any Output rights we do obtain are transferred to you. A result can be similar to another result, lack copyright protection, or involve someone else’s protected interests. Before using it, you must check your source material and planned use against copyright, trademark, likeness, privacy, publicity, and comparable rules.

Creating media does not automatically publish either the source or result to a public community. Get every permission needed before submitting another person’s likeness, voice, data, or protected creation.

5. Responsible use

You may not use ChopBerry to request, create, upload, distribute, or assist content or activity that:

6. Safety, moderation, and reporting

When an item or account event is reported or triggers a safety signal, automated controls and properly authorized reviewers may evaluate it. No screening system catches every breach. Subject to law, our response may include refusing generation, taking down a stored item, limiting functionality, freezing or closing access, retaining relevant evidence, or notifying authorities about suspected illegality.

Report non-consensual, impersonating, infringing, illegal, or harmful use through an in-app control where available or email support@chopberry.com with the subject “ChopBerry Content Report.” Include enough information to locate and understand the issue. A copyright notice should identify the protected work and disputed material, provide contact details, state a good-faith belief that the use is unauthorized, confirm accuracy, and include a physical or electronic signature.

Our operational goal is to confirm receipt within three days and complete an initial review of a valid report within seven business days. Child-safety and immediate physical-risk cases receive priority. Complicated facts or legal limits can require more time, so these timeframes are targets rather than warranties.

Available purchases include automatically renewing weekly and monthly plans. ChopBerry can also make credits or promotional access available separately. Checkout states the charge, currency, renewal interval, benefits, applicable tax, and relevant credit usage before confirmation. Unless you turn renewal off before the upcoming billing date, Google Play charges its linked payment method for the next period.

A credit is permission to run an eligible feature, not cash or transferable value. Credits bought by a user remain until consumed or the related account is closed, except when a different expiration was disclosed in advance. Cost can vary with the tool, duration, resolution, number of results, or chosen configuration and is displayed or made accessible before the task begins.

When a ChopBerry-side technical error is verified to have used credits without producing the requested deliverable, the response will be a credit restoration, a practical chance to rerun the job, or another legally required solution. A completed creative result that differs from personal taste does not alone establish technical failure.

Payment is handled by Google Play or another permitted channel under that channel’s rules; full card credentials do not reach us. Later offers may carry different benefits or pricing, but they do not alter an already completed one-time transaction. A recurring-price change follows Google Play’s required notification and consent process.

8. Cancellation, refunds, and purchase support

To stop the following charge, switch off renewal in Google Play before its stated cutoff. Normally the current paid access continues to the end of that period, subject to store rules and mandatory local law. Uninstalling, signing out, abandoning use, or closing the ChopBerry profile leaves a Google Play subscription active and does not undo a completed transaction.

Refund eligibility and approval for a Google Play order are decided through the store’s applicable rules. You can begin at Google Play’s refund flow. If a purchase was not delivered, a paid function technically failed, a charge is duplicated or unrecognized, billing is incorrect, or an order cannot be located, write to support@chopberry.com. Send the account identifier, Google order number, purchase date, item, amount, explanation, and helpful screenshots—never send full card credentials or a security code.

Our target is to respond to a complete billing case within two days. Decisions and posting time controlled by Google, another processor, a financial institution, or mandatory law cannot be guaranteed by ChopBerry. Give Support an opportunity to investigate before starting a chargeback. While a dispute is open, relevant order and usage evidence may be shared with the payment channel and the challenged benefit may be paused. Statutory consumer relief is unaffected.

9. ChopBerry intellectual property

ChopBerry’s application, user interface, branding, visual assets, documentation, and other supplied materials are owned by TKC Hospitality Group LLC or the relevant licensor. Your right to access them is individual, narrow, withdrawable, non-exclusive, and cannot be assigned; it covers ordinary use that follows this agreement. Suggestions can inform product improvements without compensation. We will not publicly attribute feedback to you unless you agree.

10. Service changes, suspension, termination, and discontinuation

Product choices, safety needs, legal requirements, technical constraints, or provider availability can lead us to revise or withdraw functionality. A serious violation, suspected fraud, unpaid amount, security threat, harmful behavior, or binding rule can lead to limits, suspension, or closure. When circumstances and law allow, Support will provide notice and a route to challenge the action.

You can stop using ChopBerry and request account deletion at any time. Accepted requests ordinarily remove the authentication account, profile and service records, generation history, ChopBerry-controlled stored media, and temporary data within 24 hours. Payment-order records retained for compliance and audit, logs awaiting configured expiry, Adapty profiles and transactions, and copies kept by third-party generation providers are not removed through the current account-deletion flow. Deleting an account does not cancel Google Play billing.

For a permanent shutdown, our goal is to notify users no less than 30 days beforehand when feasible. If closure strands an unexpired paid benefit or bought credits, the response will follow mandatory law and the remedies the original payment route is capable of delivering.

11. Service and AI disclaimers

To the extent law permits, ChopBerry is provided in its current form and subject to availability. We do not promise uninterrupted or error-free access, a particular creative result, continued availability of a model or feature, accuracy, uniqueness, non-infringement, or compatibility with every device. AI output can include artifacts, inaccuracies, bias, or unexpected content.

Use ChopBerry for creativity—not for professional guidance or consequential decisions about health, law, money, employment, lending, housing, school admission, identity, or personal safety. A generated item is not verified evidence and must not be the only basis for deciding another person’s rights, eligibility, safety, or access to an essential service. Compulsory warranties and consumer guarantees continue to apply.

12. Limitation of liability

Where the governing rules permit this allocation, TKC Hospitality Group LLC, its affiliates, personnel, and licensors exclude indirect, incidental, special, consequential, exemplary, and punitive loss. Examples include loss of information, income, profit, reputation, or business opportunity arising from ChopBerry. The aggregate ceiling across connected claims is what you actually paid for ChopBerry in the twelve months before the underlying event.

No exclusion or cap applies to conduct or responsibility that law makes non-excludable, including where relevant fraud, intentional wrongdoing, gross negligence, negligent injury or death, our own infringement, or mandatory consumer remedies.

13. Governing law and disputes

Start a dispute by sending support@chopberry.com a written account of what happened and the outcome requested. For the following 30 days, each side will make a genuine effort to settle informally. Either side may still seek time-sensitive protection concerning safety, confidential information, or intellectual property.

These Terms and any dispute arising out of or relating to them or ChopBerry are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules. Subject to mandatory consumer protections and mandatory venues in your place of residence, the state courts located in Woodford County, Kentucky, and the federal courts serving Woodford County have exclusive jurisdiction. Each party consents to personal jurisdiction and venue in those courts. These Terms do not require arbitration or waive participation in a class action.

14. General terms

If a provision is invalid, it will be narrowed only as much as necessary and the remaining terms stay effective. Delay in enforcement is not a waiver. You may not transfer these Terms without our approval. We may transfer them with a financing, restructuring, acquisition, merger, or transfer of the Service. Events outside reasonable control can delay performance but do not excuse payment or remove a mandatory consumer remedy.

This document, ChopBerry’s Privacy Policy, and the terms displayed for an individual purchase make up the relevant agreement. A material revision receives a new effective date plus any legally required notice or consent. The English text prevails only when local rules allow that language choice.
